Privacy Policy
This Privacy Policy explains how Nomos (“Nomos”, “we”, “us”, or “our”), collects, uses, discloses, and protects your personal information.
Nomos is an Australian business. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where we handle the personal information of people in other regions, we also seek to comply with applicable laws including the EU and UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA).
This policy applies to our website, marketing activities, and sales enquiries. Where Nomos processes data on behalf of a customer under a separate agreement (for example, media-operations data in the Nomos platform), that processing is governed by that agreement and any applicable Data Processing Addendum, not this policy.
1. Information we collect
We collect personal information that is reasonably necessary for our business functions, including:
- Information you give us: when you request a demo or contact us, including your name, work email, company, role, and anything you include in your message.
- Technical information: when you visit our website, including IP address, browser and device type, pages viewed, referring URLs, and similar log data, collected via cookies and analytics (see Cookies).
- Communications: records of correspondence and meetings when you engage with our sales or support teams.
We do not intentionally collect sensitive information (as defined in the Privacy Act) through this website. Please do not send us sensitive information unless we specifically request it.
2. How we use your information
We use personal information to:
- respond to your enquiries and arrange and deliver product demonstrations;
- provide, operate, and improve our website and services;
- send you information you have requested, and, where permitted, relevant marketing communications;
- understand how our website is used, and improve its performance and security; and
- meet our legal, regulatory, and contractual obligations.
Where required (for example, under GDPR), our legal bases for processing are: your consent; performance of a contract or steps taken at your request before entering a contract; our legitimate interests in operating and growing our business; and compliance with legal obligations.
3. When we disclose your information
We may disclose personal information to:
- Service providers who help us run our business (for example, hosting, email, analytics, and customer-relationship tools), under obligations of confidentiality;
- Professional advisers such as lawyers and accountants, where reasonably necessary;
- Authorities or other parties where required or authorised by law, or to protect our rights, safety, or property; and
- A successor entity in connection with a business sale, merger, or restructure.
We do not sell your personal information.
4. Overseas disclosure
Some of the service providers we rely on — such as cloud hosting, email, analytics, and customer-relationship tools — may store or process personal information outside Australia. Depending on the provider, this may include the United States, the European Union, and the United Kingdom. Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, including through appropriate contractual safeguards. If you would like more detail about where your information may be handled, contact us using the details below.
5. Cookies and analytics
Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand usage. We may use analytics and advertising-platform tools (for example, to measure marketing performance). You can control cookies through your browser settings; disabling some cookies may affect site functionality.
6. How we protect your information
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure, including access controls, encryption in transit, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. How long we keep your information
We keep personal information only for as long as it is needed for the purposes described in this policy, or as required by law. When it is no longer needed, we take reasonable steps to destroy or de-identify it.
8. Data breaches
If a data breach involving your personal information is likely to result in serious harm, we will assess, contain, and respond to it in line with our obligations under the Notifiable Data Breaches scheme in the Privacy Act 1988 (Cth). Where the scheme requires it, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
9. Your rights and choices
Subject to applicable law, you may:
- request access to the personal information we hold about you;
- request that we correct, update, or delete your information;
- opt out of marketing communications at any time, using the unsubscribe link or by contacting us; and
- where GDPR or CCPA applies, exercise additional rights such as data portability, restriction or objection to processing, withdrawal of consent, and the right not to be discriminated against for exercising your rights.
To make a request, contact us using the details below. We may need to verify your identity before acting on a request.
10. Complaints
If you have a concern about how we have handled your personal information, please contact us first so we can try to resolve it. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. Individuals in other regions may also have the right to complain to their local data protection authority.
11. Children
Our website and services are intended for businesses and are not directed to children. We do not knowingly collect personal information from children.
12. Changes to this policy
We may update this policy from time to time. The “Last updated” date at the top shows when it was last revised. Material changes will be posted on this page.
